1.1. These Terms and Conditions ("Terms") govern your use of the Secure ID email cybersecurity service ("the Service"), provided by Garden ("we," "us," "our," "the Company").

1.3. By registering for, accessing, or using the Service, you ("User," "you," "your") confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.
1.4. The Service is currently in a beta testing phase ("Beta" or "Beta Version"). This means the Service may contain bugs, errors, and may not be as reliable as a commercially released product.
2.1. Secure ID provides a software-based service that analyses your incoming email communications to identify and filter unwanted messages such as spam, phishing attempts, malware, and other cyber threats.
2.2. The Service operates by processing emails sent to your Secure ID email addresses. Our algorithms analyse this data to determine the likelihood of a message being malicious or unsolicited.
2.3. You understand that no cybersecurity solution can guarantee 100% effectiveness. While Secure ID aims to reduce threats, we cannot guarantee that all malicious emails will be blocked or that all legitimate emails will never be incorrectly filtered.
3.1. You acknowledge that the Service is a Beta Version and is provided for testing and evaluation purposes.
3.2. You agree that the Beta Version may not be fully functional, may contain errors or design flaws, and may have reduced or inconsistent performance compared to a final commercial product.
3.3. We strongly recommend that you do not rely solely on the Beta Service as your primary cybersecurity measure. You should maintain your existing security practices.
4.1. To use the Service, you must register for an account using a valid email address, phone number for account recovery and create a secure password.
4.2. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
5.1. We Do Not Sell Your Data. Our core principle is to protect your privacy. We do not sell your personal data to third parties. We do not sell advertising based on your personal data.
5.2. To provide the Service, we must process the metadata and content of your emails. This processing is essential for the performance of our contract with you (i.e., protecting your inbox).
5.3. Our processing of your personal data, including emails, is governed by the EU General Data Protection Regulation (GDPR), including its implementation in any EU state,, and our Privacy Policy, which is incorporated into these Terms by reference.
5.4. We act as a Data Processor for the data within your emails. You are the Data Controller for this data. Our processing is done strictly on your instructions (to provide the security service) and in accordance with these Terms.
5.5. We implement robust technical and organizational measures to ensure a level of security appropriate to the risk, including encryption and strict access controls.
6.1. You warrant that you own the email account and phone number you register with the Service or that you have the necessary permissions to use it with our Service.
6.2. You agree not to use the Service for any illegal or unauthorized purpose. You must not misuse our Service by knowingly introducing malicious software or content.
6.3. You are solely responsible for the content of the messages you receive and send. ID Garden does not assume any liability for the content processed through our Service.
6.4 You agree to respect any restrictions we set in order to prevent the service being abused, for example limiting the number of services you may have for a given third party provider. You may not circumvent such limits by any means for example signing up for multiple accounts including family member accounts.
6.5 When you forward messages to your primary email provider you agree not to mark them as spam through your primary email provider, as this will lower the reputation of ID Garden email servers rather than the original sender.
7.1. All intellectual property rights in the Service, its software, and all marketing materials are and will remain the exclusive property of Garden and its licensors.
7.2. We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service for the duration of these Terms.
8.1. The Service is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, express or implied. To the fullest extent permitted by law, Garden disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement.
8.2. In no event shall Garden, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business interruption, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
8.3. Notwithstanding the above, our total aggregate liability to you for any and all claims arising out of or in connection with these Terms shall be limited in the amount to the predictable damage typical to contracts of this kind.
8.4. This limitation of liability does not apply in cases of wilful intent, gross negligence, or for death or personal injury caused by our negligence. It also does not affect any liability which cannot be excluded or limited under applicable mandatory law.
9.1. These Terms will remain in effect while you use the Service.
9.2. You may terminate your account and these Terms at any time by deleting your account within the Service or by contacting us.
9.3. We may suspend or terminate your access to the Beta Service at any time, for any reason, with or without notice.
10.1. These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law principles.
10.2. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Berlin.
We reserve the right to modify these Terms at any time. We will provide notice of changes by updating the "Last Updated" date and, for significant changes, we may also provide notice via email or within the Service. Your continued use of the Service after any modification constitutes your acceptance of the new Terms.
